The NBA is investigating and has started the arbitration process regarding information that Minnesota, agent Eric Fleisher, and Joe Smith violated the NBA collective bargaining agreement by reaching a secret agreement for a future contract between Minnesota and Smith when he gains Larry Bird rights with Minnesota (2001-02). Smith signed a 1 year, $1.75 million contract in January 1999; signed a 1 year, $2.1 million contract August 17, 1999; and signed a 1 year, $2.32 million contract August 8, 2000. Minnesota and Smith reportedly have an agreement for a new multi-year, multi-million contract for next summer to compensate Smith having played the past 3 seasons under market value. Minnesota owner Glen Taylor said that VP of Basketball Operations Kevin McHale and coach/GM Flip Saunders were unaware of the agreement. Fleisher is no longer Smith's agent. If found guilty, Minnesota can face fines up to $3,500,000, forfeiture of draft picks, voiding Smith's contract, and suspensions up to 1 year of any team personnel involved. The NBA Players Association is responsible for imposing discipline for agents and players who violate the CBA. Miami signed Todd Fuller to a 1 year, minimum contract.
